Section 1

Acceptance

Using eAuction — whether browsing, registering, bidding, or listing — means you accept these Terms and our Privacy Policy. If you disagree, please do not use the Platform.

Updates: We'll notify registered users by email at least 7 days before any material changes take effect. Continued use after that date means you accept the updated Terms.

Section 2

Eligibility & Registration

To create an account you must be at least 18 years old, have the legal capacity to enter contracts under Nigerian law, and provide accurate information. You're responsible for all activity on your account — notify us immediately if you suspect unauthorised access.

Institutional sellers: Seller accounts are vetted and approved by our team before activation. In many cases, our staff upload and publish the listing on the seller's behalf using information the seller provides — the seller remains responsible for the accuracy of that information and for fulfilling the sale.

Section 3

Bidding Rules

All bids are legally binding offers. Winning a bid creates an enforceable obligation to complete the purchase. Assets are sold as-is unless stated otherwise, and bids cannot be retracted once placed.

Reserve prices: Where a reserve applies it won't be disclosed before auction close. If bidding doesn't meet the reserve, the seller is not obligated to sell.

Section 4

Payments & Fees

All transactions are in Nigerian Naira (₦). A refundable deposit is paid via Paystack at the time of bidding, held by the Platform, and returned within 5–10 business days to unsuccessful bidders. The winning bidder must pay the remaining balance directly to the seller's own bank account (shown on the auction page) within 3–7 business days of auction close — the Platform does not receive, process, or hold this payment.

Collection: There is no shipping or delivery service. Once the balance is paid, the buyer arranges collection of the item directly with the seller. The Platform does not hold, ship, or return items on either party's behalf.

Section 5

KYC & Verification

We require identity verification before users can bid on certain auctions or process withdrawals, in line with Nigeria's anti-money laundering regulations. Documents typically include a valid government-issued ID, proof of address, and BVN confirmation. Unverified accounts have restricted access.

Section 6

Prohibited Conduct

Strictly prohibited: shill bidding, bid collusion, identity fraud, listing stolen or encumbered assets, automated scraping, system interference, and harassment of users or staff.

Consequences: Immediate suspension or permanent ban, forfeiture of deposits, and referral to the EFCC, NFIU, or other Nigerian regulatory authorities.

Section 7

Intellectual Property

All Platform content — name, logo, design, and software — belongs to eAuction or its licensors. You may not copy, reproduce, or reverse-engineer any part without written consent. Seller content remains theirs; by submitting it you grant us a licence to display it in the listing.

Section 8

Liability

eAuction is a marketplace connecting buyers and sellers — we are not a party to sale contracts. To the extent permitted by Nigerian law, we are not liable for indirect damages, seller inaccuracies, buyer–seller disputes, or platform downtime. Our total liability shall not exceed fees paid by that user in the preceding 12 months.

Section 9

Termination

We may suspend or close accounts at any time for breach of these Terms, fraud, failed KYC, or a court order. You may request voluntary deletion by contacting us. Outstanding bid obligations remain enforceable after any termination.

Section 10

Governing Law & Disputes

These Terms are governed by Nigerian law (CAMA 2020, FCCPA 2018). Disputes are first subject to 30 days of good-faith negotiation, then binding arbitration in Abuja under the Arbitration and Conciliation Act. Either party may seek emergency injunctive relief from a Nigerian court.
